1. Binding contract
1.1 City of Edinburgh Council of Waverley Court, a local authority in terms of the Local Government etc (Scotland) Act 1994, with principal place of business at 4 East Market Street, Edinburgh, EH8 8BG ( “we/us”).

2. Information about us
2.1 The Outdoor Learning Map is managed by the Sport and Outdoor Learning Unit.
2.2 The Outdoor Learning Map website is owned and operated by us.
2.3 The Outdoor Learning Map is a publicly viewable platform designed to promote and support outdoor learning.

3. Changes to these terms
3.1 We amend these terms from time to time. Every time you wish to use this site or, please check these terms to ensure you understand the terms that apply at that time.

5. Using our site
5.1 Access to the Outdoor Learning Map is provided on an 'as-is' basis. We do not provide any guarantee or warranty as to its availability, accuracy, completeness or performance.
5.2 We cannot guarantee that the site or any content on it will always be available or be uninterrupted. We will endeavour to notify users in advance of downtime, however, the site may be suspended, restricted, withdrawn, discontinued or parts of the site changed, without notice and we will not be liable to you if this occurs.
5.3 You are responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.
5.4 In order to improve the service that we offer, we may add or remove functionalities or features, and we may suspend, stop or remove functions or features altogether.
5.5 Although we have taken reasonable steps to ensure that the information on the Outdoor Learning Map is correct, it is possible the information may contain errors, or be incomplete, or out of date. We therefore make no representations, warranties or guarantees (express or implied) regarding accuracy, completeness or currency of the information.
5.6 The content on the Outdoor Learning Map is provided for general information only and is not intended to amount to advice on which you should rely. We make no representations, warranties or guarantees, whether express or implied that the content on our site is accurate, complete or up to date. We therefore disclaim all liability and responsibility arising from any reliance that you or anyone else places on such content. You are responsible for assessing the risks and obtaining any required specialist advice before taking any action on the basis of the content we provide.
5.7 Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.
5.8 You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
5.9 We do not store terrorist content.
6. Registered users - services and passwords
6.1 We may restrict access to certain areas of our site to registered users (for example, the capability to contribute is only available to registered users).
6.2 If you choose, or are provided with, a username, password or some other piece of security information as part of our registration processes, you must treat such information as confidential and must not disclose it to anyone.
6.3 We have the right to disable your username, password, or other security information, (whether chosen by you or allocated by us), at any time; and suspend or terminate your registration, if in our reasonable opinion you have failed to comply with any of the relevant terms and conditions pertaining to that service.

7. User generated content
7.1 Our site allows registered users to upload content to the Outdoor Learning Map, such content is referred to as “user generated content”. Whenever you make use of the feature which allows you to upload user generated content, you must comply with the content standards set out in these Terms and Conditions.
7.2 You use and view all user generated content at your own risk and we do not warrant its accuracy or reliability. Views expressed in any user generated content are those of individual contributors and not necessarily those of CEC.
7.3 User generated content must not include any of the following:
a) material which is illegal or promotes illegality;
b) material which is offensive, indecent, threatening or abusive;
c) defamatory or misleading material;
d) material which breaches copyright or any other intellectual property rights;
e) any identifiable images of persons without their explicit consent, see Image Sharing Policy;
f) advertisements;
g) personal information about you or a third party; or
h) material which contains a virus or other harmful component.
7.4 We reserve the right to suspend or permanently block any user's access to the Outdoor Learning Map at any time if we reasonably suspect that such user is in breach of the terms and conditions of this agreement.
7.5 We will treat all user generated content as non-confidential. You retain all of your ownership rights in your user generated content but you are required to grant us and other users of our site a limited licence to use, store and copy that content and to distribute and make it available to third parties. The rights you license to us are described in clause 8.3 below.
7.6 We are not responsible for any user generated content, but we may check it from time to time.
7.7 We may remove or edit any user generated content at our entire discretion and subject to any rights we provided on our site.
7.8 By uploading content to the Outdoor Learning Map you understand that this is a publicly viewable platform and that content you share may be freely downloaded, used and modified by others.
7.9 We do not claim copyright of any user generated content but by uploading content to our site you grant us permission to display the user generated content on the Outdoor Learning Map reproduce and distribute the content in other resources we may produce. You warrant that any user generated content that you upload complies with the standards set out in these terms and conditions and you will be liable to us and indemnify us for any breach of that warranty. This means that you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
7.10 You may revoke permission for us to display your content on the Outdoor Learning Map at any time by contacting us at This email address is being protected from spambots. You need JavaScript enabled to view it. and we will remove your content. We are unable to rescind use of your user generated content that has already been downloaded by other users.
7.11 We have the right to disclose your identity to any third party who claims that any user generated content submitted by you constitutes a violation of their intellectual property rights or of their right to privacy.

8. Intellectual Property Rights
8.1 We are the owner or licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved
8.2 You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.
8.3 When you upload or post content to our sight you grant us a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display and perform that user generated content in connection with the Outdoor Learning Map. Such licence will expire should you delete your user generated content from the site.
9. Linking
9.1 You may link to our Site provided that:
a) You do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
b) You do not misrepresent your relationship with us or present any false information about us, for example by implying any form of association, approval or endorsement on our part where none exists.
c) You do not do so in a way that is likely to give your users the impression that our content is yours.
d) You do not create a border or frame or any other browser environment around our site.
e) The website you link from does not contain content that is indecent, offensive or illegal, or infringes any intellectual property rights or other rights.
9.2 We may withdraw your permission to link to our sites and/or services without notice.
9.3 Any third-party websites we link to are outside our control and we accept no responsibility for their content or for the products or services they provide.
10. No Warranty
10.1 We do not warrant that our site or its server are free from viruses or bugs. It is your responsibility to implement any procedures and virus checks to satisfy your own requirements.

13. Governing Law
