1. Binding contract
1.1 City of Edinburgh Council of Waverley Court, a local authority in terms of the Local Government etc. (Scotland) Act 1994, with principal place of business at 4 East Market Street, Edinburgh, EH8 8BG (“we/us”).

2. Information about us
2.1 The Outdoor Learning Map is managed by the Sport and Outdoor Learning Unit.
2.2 The Outdoor Learning Map website is owned and operated by us.
2.3 The Outdoor Learning Map is a publicly viewable platform designed to promote and support outdoor learning.

3. Changes to these terms
3.1 We amend these terms from time to time. Every time you wish to use this site, please check these terms to ensure you understand the terms that apply at that time.
4. Privacy policy
4.1 You agree and acknowledge the terms of the Provider’s Privacy Notice, found at: https://outdoorlearningmap.com/privacy.php
5. Using our site
5.1 Access to the Outdoor Learning Map is provided on an “as-is” basis. We do not guarantee availability, accuracy, completeness or performance.
5.2 We cannot guarantee that the site or any content will always be available or uninterrupted. The site may be suspended or changed without notice.
5.3 You are responsible for ensuring all persons accessing the site through your internet connection understand and comply with these terms.
5.4 We may add, remove, suspend or stop functionalities or features.
5.5 Although we take reasonable steps to ensure accuracy, information may contain errors, be incomplete or out of date.
5.6 Content is for general information only and should not be relied upon as advice. You must assess risks and seek specialist advice if needed.
5.7 Links to third-party sites are for information only. We do not control or endorse external content.
5.8 You must not misuse the site by introducing malicious software or attempting unauthorised access. Breaches may be reported to authorities.
5.9 We do not store terrorist content.
6. Registered users – services and passwords
6.1 Some areas may only be accessible to registered users.
6.2 Any username, password or security information must be kept confidential and not shared.
6.3 We may disable or terminate your registration if you breach these terms.
6.4 If you suspect someone else knows your login details, notify us immediately.
6.5 We will use your personal information as set out in our Privacy Policy.
7. User generated content
7.1 Registered users may upload “user generated content”. You must comply with these standards.
7.2 You use all user generated content at your own risk. Views expressed do not represent CEC.
7.3 User generated content must not include:
- a) illegal material or promotion of illegal acts
- b) offensive, indecent, threatening or abusive material
- c) defamatory or misleading material
- d) copyright or IP infringements
- e) identifiable individuals without explicit consent (see Image Sharing Policy)
- f) advertisements
- g) personal information
- h) viruses or harmful components
7.4 We may suspend or block access if you breach these terms.
7.5 User generated content is treated as non-confidential. You grant us and others a licence to use it as described in clause 8.3.
7.6 We are not responsible for user content but may check it periodically.
7.7 We may remove or edit user content at our discretion.
7.8 Uploaded content is publicly viewable and may be freely downloaded, used and modified by others.
7.9 You retain ownership rights but grant us a licence to display and distribute your content. You are liable for any breach of warranty.
7.10 You may revoke permission for us to display your content by contacting us. We cannot withdraw content already downloaded by others.
7.11 We may disclose your identity to third parties claiming rights violations.

8. Intellectual Property Rights
8.1 We own or license all intellectual property on our site. All rights reserved.
8.2 You must not use site content for commercial purposes without a licence.
8.3 By uploading content, you grant us a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display and perform that content. The licence expires when you delete the content.
9. Linking
9.1 You may link to our site provided that:
- a) Links are fair, legal and do not damage our reputation.
- b) You do not misrepresent your relationship with us.
- c) You do not imply our content is yours.
- d) You do not frame our site.
- e) Your site does not contain indecent, offensive or illegal content.
9.2 We may withdraw link permission at any time.
9.3 We accept no responsibility for external websites we link to.
10. No warranty
10.1 We do not warrant that our site or its servers are free from viruses or bugs. You must implement your own protections.
